1. Introduction

Welcome to UnderBrella. By accessing or using our website at underbrella.com.au, you agree to be bound by these Terms of Service. Please read them carefully before using our platform.

UnderBrella is operated by Rebecca Quinn (ABN 16935217446), trading as UnderBrella.

If you do not agree to these terms, please do not use our website or services.

2. About UnderBrella

UnderBrella is an Australian online marketplace and lifestyle platform offering products and resources across four core categories:

Drive — automotive parts, accessories and transport products

Home — homewares, lifestyle, fashion and family products

Self & Family — health, beauty, wellness and family essentials

Level Up — career tools, resources and work-related products

3. Eligibility

By using UnderBrella, you confirm that:

You are at least 18 years of age, or have parental/guardian consent

You are located in Australia or are purchasing for delivery to an Australian address

You have the legal capacity to enter into a binding agreement

All information you provide is accurate and truthful

4. Account Registration

When creating an account with UnderBrella, you agree to:

Provide accurate and complete information

Keep your login credentials secure and confidential

Notify us immediately of any unauthorised access to your account

Take responsibility for all activity that occurs under your account

UnderBrella reserves the right to suspend or terminate accounts that violate these terms.

5. VIP Membership

UnderBrella offers optional paid membership tiers:

Brella VIP — Monthly subscription providing personalised shopping experiences, member-only pricing and exclusive deals.

Brella Plus — Monthly subscription providing all VIP benefits plus access to our full resource hub including service directories, booking tools and lifestyle resources.

By subscribing to a membership tier, you agree to:

Recurring monthly billing on your nominated payment method

Our cancellation policy (see Section 10)

Our refund policy for subscription fees (see Section 11)

Subscription pricing is displayed at checkout and may be subject to change with 30 days notice.

6. Products and Pricing

All prices are displayed in Australian Dollars (AUD) and include GST where applicable

UnderBrella sells both its own products and products sourced through third-party suppliers (dropshipping)

Product availability is subject to change without notice

We reserve the right to cancel orders where pricing errors occur

Product images are for illustrative purposes and may vary slightly from the actual product

7. Orders and Payment

When you place an order, you confirm that:

You are authorised to use the payment method provided

All billing information is accurate and complete

UnderBrella accepts payment via Shopify Payments, which may include credit/debit cards and other available payment methods. Your order is confirmed once payment is successfully processed and you receive a confirmation email.

8. Shipping and Delivery

UnderBrella offers free shipping on orders over $75 Australia-wide

Delivery timeframes vary depending on the product and supplier

Some products are shipped directly from third-party suppliers and may have separate delivery timeframes

UnderBrella is not responsible for delays caused by third-party carriers or customs

Risk of loss and title for products passes to you upon delivery

9. Returns and Exchanges

UnderBrella complies with the Australian Consumer Law (ACL). You are entitled to a remedy if a product is:

Faulty or defective

Not as described

Unfit for its intended purpose

To initiate a return or exchange, please contact us at support@underbrella.com.au within 30 days of receiving your order.

Please note:

Change of mind returns are accepted within 14 days of delivery, provided items are unused and in original packaging

Return shipping costs for change of mind returns are the customer's responsibility

Some products sourced from third-party suppliers may have their own return policies, which will be clearly communicated

10. Cancellations

Order cancellations: Orders may be cancelled within 24 hours of placement. Once an order has been dispatched, it cannot be cancelled.

Subscription cancellations: VIP and Plus memberships may be cancelled at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.

11. Refunds

Refunds will be issued where:

A product is faulty, damaged or not as described

An order is cancelled within the eligible timeframe

We are unable to fulfil your order

Refunds are processed to your original payment method within 5-10 business days.

Subscription fees are non-refundable except where required by Australian Consumer Law.

12. Intellectual Property

All content on UnderBrella, including but not limited to our logo, brand name, website design, text, images and graphics, is the intellectual property of UnderBrella and is protected by Australian and international copyright laws.

You may not reproduce, distribute, modify or use our content without prior written permission.

13. User Conduct

When using UnderBrella, you agree not to:

Use the platform for any unlawful purpose

Attempt to gain unauthorised access to our systems

Post false, misleading or defamatory content

Infringe on the intellectual property rights of others

Engage in any conduct that disrupts or damages our platform

14. Third-Party Links and Services

UnderBrella may contain links to third-party websites, services or resources. These are provided for your convenience and do not constitute an endorsement. UnderBrella is not responsible for the content, accuracy or practices of third-party sites.

15. Disclaimer of Warranties

UnderBrella is provided "as is" without warranties of any kind, express or implied, except where required by Australian Consumer Law. We do not guarantee that our website will be uninterrupted, error-free or free from viruses.

16. Limitation of Liability

To the maximum extent permitted by law, UnderBrella's liability to you for any claim arising from your use of our platform is limited to the amount you paid for the relevant product or service.

Nothing in these terms excludes, restricts or modifies any rights you have under the Australian Consumer Law.

17. Privacy

Your privacy is important to us. Please refer to our Privacy Policy at underbrella.com.au/privacy for information on how we collect, use and protect your personal information.

18. Changes to These Terms

UnderBrella reserves the right to update these Terms of Service at any time. Changes will be posted on this page with an updated date. Continued use of our platform after changes constitutes acceptance of the updated terms.

19. Governing Law

These Terms of Service are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
